This End-User License Agreement (“EULA”) is a legal agreement between you and D.C. Dash Delivery LLC (doing business as D.C. Dash) (“Company”, “we”, “us”, or “our”), the provider of the D.C. Dash website and any associated services, software, and content (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not use or access the Service.
1. LICENSE GRANT
Subject to the terms of this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.
2. RESTRICTIONS
You agree not to:
- Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service.
- Use the Service for any commercial purpose, or for any public display (commercial or non-commercial).
- Attempt to decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the software used in the Service.
- Remove any copyright or other proprietary notices from the Service.
- Transfer the materials to another person or “mirror” the materials on any other server.
3. TERMINATION
This EULA is effective until terminated by either you or the Company. Your rights under this EULA will terminate automatically without notice from the Company if you fail to comply with any terms of this EULA. Upon termination of this EULA, you must cease all use of the Service and destroy all copies, full or partial, of the Service.
4. DISCLAIMER OF WARRANTIES
The Service is provided “as is” and “as available,” without warranty of any kind, either express or implied. Without limiting the foregoing, the Company explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, and any warranties arising out of course of dealing or usage of trade. The Company makes no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
5. LIMITATION OF LIABILITY
In no event will the Company be liable for any incidental, special, consequential, or indirect damages arising out of or related to this EULA or the Service, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not the Company has been informed of the possibility of such damage, even if a remedy set forth herein is found to have failed its essential purpose.
6. GOVERNING LAW
This EULA and your use of the Service will be governed by and construed in accordance with the laws of the State of Colorado, United States, without giving effect to any choice or conflict of law provision or rule.
7. ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and the Company regarding the Service and supersedes all prior and contemporaneous written or oral agreements between you and the Company.
8. AMENDMENTS
The Company reserves the right, at its sole discretion, to modify or replace this EULA at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
